Terms of Service
These Terms of Service ("Terms") govern your access to and use of Meme Studio (the "Service"), operated by Meme Studio ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Meme Studio. By using the Service, you represent that you meet this requirement and that the information you provide during registration is accurate and complete.
2. Account and Credentials
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@viralmemelab.com if you suspect unauthorised access. We are not liable for losses resulting from unauthorised use of your account.
3. Credits and Billing
- Free credit: New accounts receive 1 (one) free generation credit. This credit is non-transferable and expires if the account is closed.
- Paid credits: Additional credits can be purchased or obtained through a subscription plan (when available). All purchases are final and non-refundable unless required by applicable law.
- Credit deduction: One (1) credit is deducted per successful generation job. Failed jobs due to service errors will not deduct a credit. We reserve the right to adjust credit pricing with 14 days' notice.
- No negative balance: You cannot initiate a generation if your credit balance is zero.
4. Acceptable Use
You agree not to use Meme Studio to:
- Generate, upload, or distribute content that is illegal, hateful, discriminatory, threatening, sexually explicit involving minors, or otherwise harmful.
- Infringe on any copyright, trademark, or other intellectual property rights.
- Upload images of real individuals without their consent in ways that are defamatory, deceptive, or violate their privacy.
- Attempt to reverse-engineer, scrape, or interfere with the Service or its underlying infrastructure.
- Circumvent rate limits, billing controls, or security measures.
- Use the Service to build a directly competing product without our written consent.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
5. Your Content
You retain ownership of the images you upload ("Input Content") and the AI-generated outputs tied to your account ("Output Content"). By uploading Input Content, you grant Meme Studio a limited, non-exclusive licence to process and store that content solely to deliver the Service to you.
You are solely responsible for ensuring you have the right to use and transform any images you upload. Meme Studio accepts no liability for claims arising from your use of third-party images.
6. AI-Generated Output
Output Content is generated by third-party AI models. Results may vary and are provided "as-is". We do not guarantee that outputs will be accurate, unique, or free from errors. You are responsible for reviewing outputs before sharing or publishing them.
Meme Studio does not warrant that Output Content is free from third-party intellectual property claims. Use generated images at your own risk.
7. Intellectual Property
The Meme Studio name, logo, interface, and all non-user content are owned by or licensed to us and protected by copyright and trademark law. You may not use our branding without our written permission.
8. Availability and Modifications
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes that affect paid users.
9. Disclaimer of Warranties
The Service is provided "as-is" and "as-available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or uninterrupted.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Meme Studio and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, or goodwill — arising from your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Meme Studio and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes shall be submitted to the competent courts of Amsterdam, the Netherlands, unless mandatory consumer protection laws in your jurisdiction require otherwise.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you by email and by posting the revised Terms on this page. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service.
